UK-Rwanda Asylum Partnership (Part 2)

In response to the criticism of the UK-Rwanda partnership, the UK government amended the partnership several times. For instance, the Safety of Rwanda Bill was published on December 6th, 2023, and was passed into law by the Parliament on April 23rd, 2024. Boris Johnson, the Prime Minister of the UK, claimed, “Anyone entering the UK illegally - as well as those who have arrived unlawfully since January 1st, 2022 - may now be relocated to Rwanda and will be assessed for their claims.” Yet, it is said that how many removals would realistically be possible is obscure. While the ultimate cost of the policy is unknown, the National Audit Office (NAO) estimated that 200,000 pounds are required for each person, whereas the UK government’s Impact Assessment for the Illegal Migration Act expects approximately 106,000 pounds per person for one’s asylum claim. 

Despite the UK government’s explanations, the UNHCR asserts that the UK-Rwanda arrangement seems to shift the responsibility for making asylum decisions and protecting refugees, further arguing that such a partnership that externalizes asylum obligations poses severe and worrying risks to refugees’ safety and is incompatible with international refugee laws. 

The criticism from academia towards the UK-Rwanda treaty is even more severe. Heaven Crawley, a member of the United Nations University Centre for Policy Research with a PhD at Oxford University, claims the policy inadequate because the partnership limits the opportunities for refugees to enter the UK legally. Rwanda lacks practices for managing a large number of refugees. However, Rwanda signed up for the Common Refugee Response Framework, which the United Nations adopted as a commitment to respect the human rights of refugees and migrants. 

Rwanda’s previous agreement with Israel, through which the majority of refugees did not remain in Rwanda, also concerns many who expect a similar consequence in the case of the UK-Rwanda partnership. Last but not least, the partnership would create a hostile environment or atmosphere that will prevent asylum-seekers from crossing the Channel to the UK in the first place. 

It has only been 76 years since the United Nations adopted The Universal Declaration of Human Rights. The recent UK-Rwanda partnership led by the UK government seems to deter the UN’s efforts for a more equal and safer society. UK’s act of sending refugees to Rwanda in the name of an ambiguous partnership reminds us of the atrocity committed by the world powers during the Age of Exploration and the periods following the age. Developed countries like the UK should not mislead countries with a false promise. Refugees have the right to choose where they go and settle down. Countries, particularly superpowers, should not pass their problems to less developed or developing countries as such attempts would result in an irreversible and tragic state of refugees and human rights in the world.

영국-르완다 파트너십에 대한 비판에 대응하여 영국 정부는 이 조약을 수차례에 걸쳐 수정했습니다. 2023년 12월 6일에 발표되고 2024년 4월 23일에 의회에서 안전법안을 통화할 때, 영국 총리인 보리스 존슨(Boris Johnson)은  “2022년 1월1일 이후 영국에 비합법적으로 입국하는 모든 사람들은 일단 르완다로 보내지고, 거기에서 그들의 난민신청은 평가받게 된다”고 선언했습니다. 하지만 현실적으로 영국-르완다 파트너십이 얼마나 많은 난민을 재배치시키너가 감소시킬 수 있을지 명확하지 않습니다.

이 정책의 큰 문제점은 정책을 시행하기 위한 최종 비용을 구체적으로 알기 어렵다는 겁니다.  국가감사원(NAO)은 1인당 200,000파운드가 필요할 것으로 추정한 반면, 영국 정부의 불법 이주법에 대한 영향 평가에서는 망명 신청에 1인당 약 106,000파운드가 필요할 것으로 예상할 뿐 구체적인 예산이나 비용도 알 수 없습니다. 

영국 정부의 주장에도 불구하고, UNHCR은 영국-르완다 협정이 망명 결정을 내리고 난민을 보호하는 책임을 더 약한 나라에 떠넘기는 행위라고 비판합니다. 또한 망명 의무를 외부로 돌리는 파트너십은 난민의 안전에 매우 심각한 위험을 초래하며, 국제 난민법과 양립할 수 없다고 비판했습니다. 

영국-르완다 조약에 대한 학계의 비판은 더욱 심각합니다. 옥스포드 대학에서 박사 학위를 받은 대학 정책 연구 센터의 회원인 헤븐 크롤리(Heaven Crawley)는 본 파트너십이 난민들이 영국에 합법적으로 입국할 수 있는 기회를 제한하기 때문에 이 정책이 부적절하다고 주장합니다. 크롤리에 따르면, 르완다는 많은 수의 난민을 관리하는 시스템이 부족하고 난민관리 역량을 보여준 적이 없다고 주장합니다. 특히  대다수의 난민이 르완다에 머물지 않도록 한 르완다-이스라엘의 협정의 사례를 지적하며 영국-르완다 파트너십은 말뿐인 조약이라고 비판합니다.  하지만 르완다 정부는 유엔의 공동 난민 대응 프레임워크(Common Refugee Response Framework)에 이미 서명을 하고, 난민을 받을 준비가 되었다고 주장하고 있습니다. 

유엔이 세계인권선언을 채택한 지는 이제 76년이 되어가고 있습니다. 영국 정부가 주도한 영국-르완다 파트너십은 보다 평등하고 안전한 사회를 위한 UN의 노력을 훼방하는 것처럼 보입니다. 영국이 모호한 파트너십의 이름으로 르완다에 난민을 보내는 행위는 탐험의 시대와 그 이후 시대에 세계 강대국들이 자행한 만행을 떠올리게 합니다. 영국 같은 선진국이 거짓 약속으로 난민 정책을 왜곡하고, 자신들의 문제를 저개발국이나 개발도상국에 떠넘겨서는 안 됩니다. 그러한 시도는 전 세계 난민과 인권의 돌이킬 수 없고 비극적인 상황을 초래할 수 있기 때문입니다.
